IOWA CITY, Iowa (AP) — A rural Iowa court official filed false documents
to say she had married a same-sex couple from Florida, even though she
never met the men and they had not traveled to the state for a ceremony,
investigators said Thursday.

Grundy County Deputy Clerk of Court Brigitte Van Nice was arrested at work
Wednesday and charged with two counts of forgery and one count of perjury,
all felonies. Van Nice, 42, posted bond and was released from jail pending
a court appearance scheduled for next week.

The arrest is believed to be the first of its kind in Iowa, one of six
states that allow gay marriage, said Iowa Division of Criminal
Investigation Special Agent Larry Hedlund.

Investigators discovered the invalid certificate after one of the men
contacted an attorney in Florida about getting a divorce, Hedlund said.

Prosecutor Jennifer Miller said charges will not be filed against the men,
who believed they had been legally married.

"We determined that they basically were the ones that were duped," Miller
said. "I don't think they were trying to fraudulently obtain a marriage
license. They were told it was fine for them to not be in the state when
they got married. I don't think they realized it was not going to be a
valid marriage."

Jennifer Pizer, a same-sex marriage expert and former legal director of
the Williams Institute at UCLA, called the arrest "quite unusual" and said
she had not heard of anything similar elsewhere.

Van Nice became ordained to perform marriages last year through a website.
The men started corresponding with her after searching the Internet for
Iowa counties where they might obtain a license, Miller said.

In February, she filed a marriage certificate at the county recorder's
office claiming she had officiated the couple's wedding on Valentine's Day
and that two women had witnessed the ceremony, according to a criminal
complaint.

Van Nice told staff in the recorder's office — located in Grundy Center,
population 2,700 — that she had met the men at a Waterloo truck stop the
day before and they lined up the witnesses, the complaint says.

Investigators later determined that the ceremony did not take place and
that Van Nice had faked the signatures of the phony witnesses without
their permission, it says.

She was paid $150 for her work.

The complaint identifies the Florida men by name but does not give their
hometowns or ages. Attempts to reach them were not immediately successful.
Van Nice officiated one other same-sex marriage in Iowa but it was valid,
Hedlund said.

She has been placed on paid administrative leave. Defense Attorney Robert
Thompson said Van Nice planned to plead not guilty.

A message left at her residence wasn't immediately returned, and it wasn't
clear whether she had retained an attorney.

Van Nice received no sympathy from One Iowa, the state's leading gay
rights group.

"If Brigitte Van Nice ... is found guilty of falsifying information on a
public record, she must be held accountable," executive director Donna Red
Wing said.

It was not known what other messages were received by agencies in Washington
from Libya that day about who might have been behind the attacks.

other Americans were killed in Benghazi, the White House on Wednesday
morning released a schedule showing that President Obama would continue
with his planned campaign trip to Las Vegas.

Before he leaves, the schedule indicated, Obama will "deliver a
statement" in the White House Rose Garden at 10:35 a.m., the White House
said.

Obama on Wednesday morning confirmed the death of Ambassador Chris
Stevens, the administration’s point man during the Libyan revolution, in

advised two hours after attackers assaulted the U.S. diplomatic mission
in Benghazi, Libya, on September 11 that an Islamic militant group had
claimed credit for the attack, official emails show.

The emails, obtained by Reuters from government sources not connected
with U.S. spy agencies or the State Department and who requested
anonymity, specifically mention that the Libyan group called Ansar
al-Sharia had asserted responsibility for the attacks.

The brief emails also show how U.S. diplomats described the attack, even
as it was still under way, to Washington.

U.S. Ambassador Christopher Stevens and three other Americans were
killed in the Benghazi assault, which President Barack Obama and other
U.S. officials ultimately acknowledged was a "terrorist" attack carried
out by militants with suspected links to al Qaeda affiliates or

of the Obama administration for its response to the attack that killed the

Americans should reserve judgment until official investigations have time to
piece together the truth.

relevant bodies do their work.”


In addition to an FBI effort to identify and track down the killers, the
State Department has launched a blue-ribbon panel, headed by veteran
diplomat Thomas Pickering, to investigate the attack. The House oversight
committee has held a public hearing, and the Senate intelligence committee
announced Thursday it would hold hearings next month.

A long list of former Republican officials have accused the Obama
administration of trying to conceal details of the attacks, including former
New York Mayor Rudolph Giuliani, who told Fox just before Rice’s appearance
that “the coverup is palpable.”

But Rice, who was Clinton’s immediate predecessor as America’s top diplomat,
sounded sympathetic to the administration’s argument that diplomats in
turbulent regions always face a degree of risk.

“You can’t simply keep your diplomats in a bunker,” she said. “They have to
get out and do their work.”

She said the State Department had procedures in place to handle security
crises, and that Congress and the State Department panel will examine if
the appropriate rules were followed given the known threats in Benghazi. “I
have no reason to believe they weren’t followed,” she added.

Rice’s predecessor, Colin Powell, on Thursday endorsed President Obama for a
second term. Powell also has refrained from criticizing the administration
for the Benghazi attacks.

Rice, one of George Bush’s closest confidantes during his two terms in the
White House, has sought to remake her political identity since Obama came to
office.

She told Fox that she is “not always in agreement with everything that’s
written in the Republican platform about social issues.”

But she disagreed with Democrats’ claims that the GOP ticket is conducting a
“war on women,” saying the Republican candidates “are going to be
reasonable … and are going to take into account the views of those with whom
